All pool safety barriers can degrade and become non-compliant over time. On 1 December 2019, new laws to improve swimming pool and spa safety came into effect in Victoria.
They introduced new registration, inspection and certification requirements for property owners.
Due dates vary depending on when the pool or spa was constructed or installed.
Pools and spas constructed or installed from 1 November 2020 onward need to be certified as compliant every 4 years.
Pools and spas that have already been certified are required to be re-certified within 4 years.
Pools and spas constructed on or before 30 June 1994 need to be certified as compliant before 1 June 2026.
It is an offence to not lodge a certificate of barrier compliance by the due date.
Your local council may issue an on-the-spot fine of approximately $395 (2 penalty units), or a court may impose a fine of up to $1975 (10 penalty units).
